    <description><![CDATA[<p><img class="alignleft size-full wp-image-3707" style="float: left;border: 0;margin: 7px" src="http://go635254.s3.amazonaws.com/redgreenandblue/files/2009/11/obama.jpg" alt="" width="250" height="345" />The White House has officially announced that <a href="http://thecaucus.blogs.nytimes.com/2009/11/25/obama-will-go-to-copenhagen/?hp&#38;emc=na" target="_blank">president Obama plans on attending the COP15 climate change conference</a> held next month in Copenhagen from December 7th to the 19th.</p>
<p>Obama will give a speech at the conference on December 9th on his way to Norway to pick up his Nobel Peace Price on the 10th.</p>
<p>Obama had not committed to making an appearance at <a href="http://en.cop15.dk/" target="_blank">COP15</a>, saying he would attend only if his presence would help lead to a successful outcome.</p>

    <title>Corps of Engineers Held Responsible for Catastrophic Flooding from Katrina</title>

<p>A federal court ruling <a href="http://www.nytimes.com/2009/11/20/us/20orleans.html" target="_blank">handed down last week</a> charged the Army Corps of Engineers with &#8220;gross negligence&#8221; that led to the catastrophic flooding in New Orleans in the wake of hurricane Katrina.<br />
U.S. District Court Judge Stanwood Duval Jr. minced no words in issuing his ruling, saying that the corps failure to properly maintain the <a href="http://www.mrgo.gov/" target="_blank">Mississippi River-Gulf Outlet</a> (MRGO) shipping channel directly contributed to the breaching levees that swamped much of New Orleans in 2005, a disaster from which many residents have yet to recover.<br />
In his ruling, Judge Duval said that Corps of Engineers &#8220;shoddy oversight&#8221; of the shipping channel located southeast of New Orleans caused much of the flooding of St. Bernard Parish and the Lower 9th Ward, two areas hit hardest flooding after Katrina smashed into the gulf coast.</p>

<p>Copenhagen is a water town, and the iconic symbol of Denmark&#8217;s capital city is the Little Mermaid silently standing watch over the harbor. Next month the Little Mermaid welcomes the global community coming to negotiate at least the foundation of an international treaty at the <a href="http://en.cop15.dk/" target="_blank">COP15</a> climate conference to carry beyond the Kyoto Protocol expiring in 2012.</p>
<p>The Little Mermaid takes her role as a symbol of climate change seriously. And she&#8217;s angry. Angry because also coming to her town are thousands of lobbyists and business (as usual) representatives intent on holding back progress for a dangerously warming world, opting instead for short term profits over long term sustainability.</p>
<p>The Little Mermaid is now the <a href="http://www.angrymermaid.org/" target="_blank">Angry Mermaid</a>:</p>
<blockquote><p>&#8220;So the Angry Mermaid decided to launch an award – in her own name – to highlight how corporate lobbyists were scheming to sabotage action to save the climate. She asked people she knew if they could suggest which companies were doing the most to undermine climate action – and she decided to publish a shortlist and ask the public to vote.&#8221;</p></blockquote>

<p>The <a href="http://www.mnn.com/lifestyle/ecollywood/blogs/after-the-international-day-of-climate-action" target="_self">International Day of Climate Action</a> last Saturday saw the power of grassroots activism leveraged by new media and social networking. Through an online and viral campaign, <a href="http://www.billmckibben.com/" target="_self">Bill Mckibben&#8217;s</a> climate action group <a href="http://www.350.org/" target="_self"><em>350.org</em></a> inspired an international response of more than 5,200 events in 181 countries. Hailed as the &#8220;most widespread day of environmental action in the planet&#8217;s history,&#8221; the action focused on a single number: 350. That&#8217;s the level in parts-per-million (ppm) many scientists now say is the safe level of CO2 in the atmosphere to avoid the worst consequences of climate change.</p>
<p>Focusing on that single number represents both the genius and the possible Achilles heal of the such a grassroots effort.</p>

<p>The <a href="http://www.theyesmen.org/" target="_blank">Yes Men</a> were up to their usual tricks yesterday, <a href="http://www.nytimes.com/gwire/2009/10/20/20greenwire-fake-reporters-part-of-climate-pranksters-thea-39576.html" target="_blank">impersonating an official from the U.S. Chamber of Commerce</a> and supposedly reversing the dogged stance the Chamber has taken on climate change. A call from the Chamber last summer to conduct a &#8220;<a href="http://redgreenandblue.org/2009/08/27/us-chamber-of-commerce-wants-a-trial-on-climate-science/" target="_self">Scopes Monkey Trial of the 21st century</a>&#8221; on climate change science (their own characterization) led to an <a href="http://www.reuters.com/article/gwmCarbonEmissions/idUS177782369620091007" target="_blank">exodus</a> of several <a href="http://redgreenandblue.org/2009/09/23/pacific-gas-electric-rejects-uschamber-of-commerce-position-on-climate-change/">prominent members</a> wanting <a href="http://www.google.com/hostednews/ap/article/ALeqM5iiYo9RobwlujuO51lppXZr41mBlgD9BF2M5G0" target="_self">nothing to do</a> with such <a href="http://www.sfgate.com/cgi-bin/blogs/green/detail?entry_id=49945" target="_blank">shenanigans</a>.</p>
<p>It seems that the Chamber didn&#8217;t find the prank so terribly amusing. Pity.</p>

    <description><![CDATA[<p><img class="alignleft size-medium wp-image-3631" style="float: left;border: 0;margin: 7px" src="http://go635254.s3.amazonaws.com/redgreenandblue/files/2009/09/green_foliage.jpg" alt="" width="250" height="166" />In April of 1994 CEO&#8217;s from the leading tobacco companies appeared before Congress and said, one by one and under oath, that <a href="http://www.youtube.com/watch?v=jQUNk5meJHs" target="_self">nicotine was not addictive</a>. That may have been the last dying gasp of organized denial of the dangers inherent in smoking.</p>
<p>What the tobacco industry learned from the early days of &#8220;<a href="http://www.youtube.com/watch?v=UyhvHB62ph8&#38;NR=1" target="_self">doctor recommended</a>&#8221; cigarettes through to that hearing in &#8216;94, was that all it took to sell the idea that smoking was good for you - or at least not that bad - was a dose of misinformation combined with a perception of scientific legitimacy in questioning established research. By tossing out a reasonable sounding tidbit of information you can keep uncertainty alive in the public&#8217;s mind and <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/09/24/AR2009092404797.html" target="_self">thwart progress</a>.</p>
<p>Which leads to the obvious conclusion that if plants need CO2 to grow, then <em>more</em> CO2, not <em>less</em>, is what the world needs now.</p>

<p>Last month the Chamber of Commerce called for a <a href="lifornia utility company PG&#38;E Corp said it is quitting the U.S. Chamber of Commerce in protest over the business lobby group's " target="_self">&#8220;trial&#8221; on climate science</a> as a means to thwart efforts in Congress to pass climate legislation, stymie the EPA&#8217;s endangerment finding regarding CO2 emissions, and needlessly continue to sow discord and confusion over the issue. It is an extremist position with which PG&#38;E apparently wants no association. On a company blog post yesterday entitled <em><a href="http://www.next100.com/2009/09/irreconcilable-differences.php" target="_self">Irreconcilable Differences</a></em>, their position was made clear.</p>

<p>Siding with a coalition of eight states, three land trusts, and the city of New York, the court made its long awaited ruling, reinstating the lawsuit  <em><a href="http://www.ca2.uscourts.gov/decisions/isysquery/cad70626-137e-4599-b5a9-28b8b9c883c2/1/doc/05-5104-cv_opn.pdf#xml=http://www.ca2.uscourts.gov/decisions/isysquery/cad70626-137e-4599-b5a9-28b8b9c883c2/1/hilite/" target="_self">State of Connecticut v. American Electric Power Co</a> (pdf)</em> brought under federal common law. The suit was rejected by a lower court judge in 2004.</p>

<p><a href="http://www.syntroleum.com/main.aspx" target="_self">Syntroleum Corporation</a> and Tyson Foods have partnered in a 50/50 venture called <a href="http://www.dynamicfuelsllc.com/" target="_self">Dynamic Fuels</a> to produce a new high-grade renewable diesel fuel. Using a proprietary <a href="http://www.syntroleum.com/proj_rba_biofining.aspx" target="_self">Bio-Synfining</a> process and a feedstock of animal fats, greases, and vegetable oils supplied from Tyson, Dynamic Fuels will produce diesel fuel with the lowest greenhouse gas emission levels of any transportation fuel available today.</p>
<p>Last month Dynamic Fuel chose <a href="http://www2.emersonprocess.com/en-US/Pages/Home.aspx" target="_self">Emerson Process Management</a> to provide the digital automation and process management systems to help <a href="http://news.thomasnet.com/companystory/829312" target="_self">operate a new $138 million renewable diesel facility</a> in Geismar, Louisiana, the largest such plant in North America. Scheduled to begin operation in 2010, the plant will produce 75 million gallons per year of of the fuel.</p>

Characterizing it as the &#8220;Scopes monkey trial of the 21st century,&#8221; the trial would come complete with witnesses, cross-examination, and a judge to &#8220;rule&#8221; on whether human activity is contributing to dangerous climate change.</p>
<p>Opponents to the idea assert the idea all but abandons the <a href="http://phyun5.ucr.edu/~wudka/Physics7/Notes_www/node5.html" target="_self">scientific method</a>, upon which modern civilization depends, in favor of what Brenda Ekwurzel, a climate scientist for the <a href="http://www.ucsusa.org/global_warming/science_and_impacts/science/" target="_self">Union of Concerned Scientists</a> says is reminiscent of &#8220;the Salem witch trials, based on myth.&#8221;</p>

<p>Two cargo ships <a href="http://www.reuters.com/article/GCA-GreenBusiness/idUSTRE57K53Z20090821" target="_self">set out last week</a> from the port of Vladivostok to traverse Russia&#8217;s Northeast Passage, marking the first time commercial ships have attempted the normally ice-bound route across Russia&#8217;s Arctic shore without the aid of icebreakers.The two ships, <em>Fraternity</em> and <em>Foresight,</em> owned by German shipper <a href="http://www.beluga-group.com/en/#YourExpertsforHeavyLiftandProjectCargo" target="_self">Beluga Shipping GmbH</a>, received permission to travel the route last Friday.</p>
<p>Bound for the Netherlands from South Korea, the route will cut 4,000 nautical miles from the typical 11,000-mile route through the Suez Canal, helping realize a &#8220;considerable&#8221; reduction in fuel consumption and CO2 emissions, said Niels Stolbert, president and CEO of Beluga.</p>

<p>Project <a href="http://www.betterplace.com/" target="_blank">Better Place</a>, the brainchild of entrepreneur and CEO Shai Agassi, in partnership with French automaker <a href="http://www.renault.com/en/groupe/developpement-durable/environnement/pages/focus-better-place.aspx" target="_self">Renault</a>, is an increasingly popular electric car service model that looks to the &#8220;service station&#8221; concept for <a href="http://gas2.org/2008/04/23/affordable-electric-cars-coming-to-us-in-2009/">electric cars</a>. By developing an infrastructure of &#8220;<a href="http://www.betterplace.com/solution/charging/" target="_blank">swap stations</a>,&#8221; drivers can swap discharged batteries in their electric cars in little more than five minutes, and be on their way. Pilot projects are already underway across the globe, including <a href="http://www.betterplace.com/global-progress/denmark/" target="_blank">Denmark</a>, <a href="http://www.betterplace.com/global-progress/israel/" target="_blank">Israel</a>, <a href="http://gas2.org/2009/05/13/better-place-unveils-first-solar-powered-electric-vehicle-battery-switching-station/" target="_blank">Japan</a>, <a href="http://gas2.org/2008/12/03/hawaii-endorses-better-place-plan-for-electric-cars/" target="_blank">Hawaii</a>, <a href="http://www.betterplace.com/global-progress/california" target="_blank">California</a>, and <a href="http://redgreenandblue.org/2008/10/23/australia-to-launch-one-of-worlds-biggest-electric-car-recharging-systems/" target="_blank">Australia</a>.</p>
<p>Renault and Better Place <a href="http://www.guardian.co.uk/environment/2009/aug/18/renault-electric-car" target="_blank">announced</a> this week plans sell up to 160,000 electric cars annually throughout Denmark and Israel starting in 2011.</p>

The letters urged Perriello to vote against the Waxman-Markey <a href="http://www.govtrack.us/congress/bill.xpd?bill=h111-2454" target="_self">American Clean Energy and Security Act of 2009.</a></p>
<p>A total of <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/08/04/AR2009080402223.html?hpid=topnews" target="_self">12 forged letters</a>, sent to three House Democrats, have thus far been uncovered. As well, as Perriello, who voted for ACES, Kathy Dahlkemper and Chris Carney of Pennsylvania also received letters claiming authorship from community organizations. Dahlkemper and Carney voted against ACES.</p>
<p><a href="http://tpmmuckraker.talkingpointsmemo.com/2009/07/congress_to_probe_forged_climate_change_letters.php" target="_self">The task now</a> is unraveling the extent of the connection between the <a href="http://www.cleancoalusa.org/" target="_self">American Coalition for Clean Coal Electricity</a>, the forged letters, and Bonner &#38; Associates.</p>

<p>About one thousand miles off the coast of California, in an isolated area of the north Pacific ocean known as the <a href="http://www.wiserearth.org/article/bea19ef898eca1e2c820690bf8d22640" target="_self">North Pacific Gyre</a>, a slowly rotating whirlpool of water swirls in a giant clockwise spiral. At the center of the swirling mass of water sits a relatively still center, inviting the accumulation of whatever debris swirls into it.</p>
<p>Created by a high pressure system of trade and westerly winds, all the oceans of the world have massive, slow-moving gyres. While oceans across the globe have accumulated debris, the north Pacific Gyre is known to have amassed at its core the largest. This giant debris field, commonly known as the <a href="http://science.howstuffworks.com/great-pacific-garbage-patch.htm" target="_self">Great Pacific Garbage Patch</a>, is estimated to be as large as the state of Texas (some sources say twice the size of Texas).</p>
<p>Scientists and researchers from the <a href="http://www.sio.ucsd.edu/" target="_self">Scripps Institute of Oceanography</a> have begun <a href="http://sio.ucsd.edu/Expeditions/Seaplex/" target="_self">new research</a> on the nature and origin of the Great Pacific Patch, as well as its effect on the local ecosystem and global food chain.</p>

His hard fought seat and freshman status left him vulnerable to Republican attacks vehemently opposed to the bill, yet he voted for the legislation nonetheless, believing it the right thing to do.</p>
<p>The decision to do so was made even harder after he received five letters from local constituency groups, including a Hispanic advocacy group and a local chapter of the NAACP, opposing the legislation. Or so he at first thought. According to an investigation by <a href="http://www2.dailyprogress.com/cdp/news/local/local_govtpolitics/article/letters_sent_to_perriello_called_fakes._area_advocates_names_forged_by_d.c./43439/" target="_self">DailyProgress</a>, it turns out those letters weren&#8217;t what they appeared to be and were in fact forged by Washington DC-area lobbyists.</p>

<p>In the spring of 2007 the <a href="http://www.csmonitor.com/2007/0403/p01s01-usju.html" target="_self">Supreme Court ruled</a> the Clean Air Act provides the authority for the EPA to regulate greenhouse gas pollution. The ruling cleared the way for the EPA to consider scientific evidence to determine if greenhouse gas emissions pose a danger to public health, and if so, should be regulated. Despite that decision, <a href="http://www.globalwarmingisreal.com/blog/2008/07/20/the-ying-and-yang-of-the-environmental-protection-agencys-position-on-climate-change/" target="_self">little headway was made</a> under the Bush Administration and then-EPA administrator Stephen Johnson.</p>
<p>The stage was set for change when the Obama administration took office, and the GOP immediately set out to block the EPA regulation of greenhouse gas emissions in anticipation of action from the EPA finally moving forward and acting on the court&#8217;s ruling. Gunn saying <em>&#8220;<strong>climate change poses a clear and present danger to the United States of America.&#8221;</strong></em></p>
<p>The hearing, entitled <a href="http://foreign.senate.gov/hearings/2009/hrg090721p.html" target="_self"><em>Climate Change and Global Security: Challenges, Threats, and Diplomatic Opportunities</em></a>, was chaired by Senator John Kerry (D) of Massachusetts with John Lugar as the ranking minority member on the committee. Witnesses on the hearing panel included former senator John Warner of Virginia; Sharon Burke, vice president of the <a href="http://www.cnas.org/" target="_self">Center for a New American Security</a>; retired Navy Vice Admiral Dennis McGinn, a member of the <a href="http://www.cna.org/" target="_self">Center for Naval Analysis Advisory Board</a>; and retired Navy Vice Admiral Lee F. Gunn, president of the <a href="http://www.americansecurityproject.org/" target="_self">American Security Project</a>.</p>

    <description><![CDATA[<p><img class="alignleft size-full wp-image-3407" style="border: 0;float: left;margin: 7px" src="http://go635254.s3.amazonaws.com/redgreenandblue/files/2009/07/chevron_richmond.jpg" alt="Richmond refinery" width="250" height="166" />Chevron Corporation <a href="http://www.reuters.com/article/marketsNews/idUSN2012285920090720" target="_self">filed an appeal</a> in the California State Court of Appeals yesterday in hopes of overturning a state Superior Court ruling made in Contra Costa County by Judge Barbara Zuniga, who tossed out Chevron&#8217;s environmental impact report for the proposed $1 billion expansion of its 107-year-old Richmond refinery, stating the report did not fully comply with the California Environmental Quality Act (<a href="http://ceres.ca.gov/ceqa/flowchart/index.html" target="_self">CEQA</a>).</p>
<p>Specifically, Zuniga ruled that Chevron&#8217;s environmental analysis failed to account for reductions in greenhouse gas emissions, saying the report lacked a detailed explanation for how the addition of a hydrogen plant and distribution pipeline would change pollution levels from the refinery.</p>
